澳大利亚消费法之品质保障 “适宜接受的品质”

供应商或零售商有义务确保所售的物品具有”适宜接受的品质”(acceptable quality – 澳大利亚消费法第54条款, 澳大洲消费法第54条款)。

“适宜接受的品质” (acceptable quality – 直译为”可被接受的品质”)的制度包含以下的保障 –
– 商品适合一般用途的需要
– 外观端正
– 没有缺陷
– 安全
– 耐用

以上的品质保障要求应该从消费人以客观的角度而定,并且需要考虑到以下情况 –
– 物品的性质
– 价钱
– 在包装或标签上的声明
– 供应商或制造商所对商品所做出的描述
– 其他相连的情况
– 以上的符合程度
以上意示”适宜接受的品质”的标准不是要达到十全十美的境界, 而是由不同情况而定如物品的性质, 价钱等等。

如果货物没遭受严重失效, 供应商可选择修补,货物对换,回收货物及推钱. 就是说,如果卖方只提议修补,买方不得索求退货并讨回钱。

若是严重的话, 以上选择权归于买方。就是说, 卖方可选择退货以及索取退款。

判定失责是否严重 –
以下情况是属于物品严重失效
– 若是已知晓品质缺陷的话,一名理智的消费者将不会接受货物
– 货品与供应商之前对品质声明,陈列样本, 示范样本有可观的差异
– 货品大致上不能被采用于一般有关的用处
– 货品不能被采用于买方之前告知卖方所需的用途而供应商不能在合理的期间内把物品为此要求而修更。
– 带有危险

什么情况可坚决退货
买方在以下情况可坚决退货并收回付款:
– 货物品质遭受严重失效 (major failure)
– 供应商拒绝或没能在合理期间内修好货物的缺陷

退货期限
这是指从接货到应该发现有关的货物失灵时候, 这期间长短由以下因素而定 :
– 货物的类似
– 一般所被派上的用途
– 一般的货物应用寿命
– 一般应用期间直到发现货物失灵

消费者必须在这段期间之内退货。

如何实行退货权
买方应该在推货期限之内通知供应商, 并且说明退货理由。
货物归还责任在于买方除非买方需要耗资可观的费用来送还。递送费额是否庞大的因素包括货物性质,体重或行状。

货物失效相应而发生的损失
除了以上的法律援助或救济, 消费者还可索取赔偿一切可合理预料到损失。不是一切所产生的损失都得到赔偿。所被预料到的损失必须在合理界线的范围里。

诸多案例与买卖二手汽车有关。

关键时间是货品过手时的状态。如果能证实潜在缺陷在买下时已存在并使到品质不适宜被接受”, 卖方必须负责任。

案例
在 Nesbit v Porter 案件里, 售卖的二手车潜在的缺陷是方向遥控箱及减震器遭严重的生銹。 故障6个月过后才显露出来。

就算买方未买时有机会式车, 这不意味着失去追究潜在的缺陷。但如果买方主动请修车技工检查汽车而发现某些疑问但还未能在购买之前查清实况, 买方可能随 McQuillan v Thomas 案件的判决, 失去主张品质不”适宜接受”的权利。 在 McQuillan v Thomas,买方的修车技工在检查时发现 . 冷却液及机油泄漏,建议买方购买前把 引擎洗净并更加 做彻底的检查, 但买方没依从, 就把车买下。过后才发现泄露的原因是引擎破裂。卖方是用机硅密封胶暂时避防解体。听审团判决

54 Guarantee as to acceptable quality
(1) If:
(a) a person supplies, in trade or commerce, goods to a consumer; and
(b) the supply does not occur by way of sale by auction;
there is a guarantee that the goods are of acceptable quality.
(2) Goods are of acceptable quality if they are as:
(a) fit for all the purposes for which goods of that kind are commonly supplied; and
(b) acceptable in appearance and finish; and
(c) free from defects; and
(d) safe; and
(e) durable;
as a reasonable consumer fully acquainted with the state and condition of the goods (including any hidden defects of the goods), would regard as acceptable having regard to the matters in subsection (3).
(3) The matters for the purposes of subsection (2) are:
(a) the nature of the goods; and
(b) the price of the goods (if relevant); and
(c) any statements made about the goods on any packaging or label on the goods; and
(d) any representation made about the goods by the supplier or manufacturer of the goods; and
(e) any other relevant circumstances relating to the supply of the goods.
